Why You Shouldn’t Always Blow from Salem, NH DWI & Criminal Defense Lawyer Mark Stevens 603-893-0074 (24/7)

Reasonable Reasons You Should Refuse Field Sobriety Tests from NH DUI Lawyer Mark Stevens 603-893-0074 (24/7)

According to DUI  attorneys roadside sobriety tests currently remain one of the most common ways used by police to measure your level of intoxication. If you find yourself in this unfortunate position, you should bear in mind that you don’t have to take these tests and here’s why…

Field sobriety tests are designed to do 2 main things:

1.) To trick you.
2.) For you to fail.

Field Sobriety Tests  (FST’s) are known to be an inaccurate measurement of sobriety. Results can be attributed to a variety of factors including weather, medication, the surface upon which they are conducted, type of footwear you are wearing, injuries, and even just anxiety.

Here are some reasons that many people refuse a field sobriety test:

1) Results can vary dramatically.

2) Tests can be inaccurate – According to the National Highway Traffic Safety Administration; several of the most popular FSTs are highly inaccurate. Take the walk-and-turn test for example. Even when administered perfectly, it only has a 68% accuracy rate.

3) Personal medical conditions can play a large role in the outcome – If you’re an individual who experiences inner ear problems; pain in your arms, feet, legs, or back; vision problems; etc., these can all play a role in the outcome of your tests, and will likely effect it negatively.

Field sobriety tests also assume that each person is exactly the same – same height, same weight, and without disabilities or other sicknesses. This means that if the field sobriety test alone can convict people, nearly one in three people would be wrongly arrested.

These reasons are just a few of the many why you should consider declining a cop’s request to perform a field sobriety test.

If you have been arrested for DWI or aggravated DWI in New Hampshire please feel free to call me today for a free consultation. Attorney Mark Stevens 1-603-893-0074.

Black Friday Shopping Tips from NH DWI Lawyer Mark Stevens 603-893-0074 [24/7]

This upcoming holiday weekend always seems to result in more than usual shoplifting and willful concealment arrests as well as other theft charges all across New Hampshire. If you are accused of any type of theft or shoplifting offense it is extremely important you do not say anything or let anyone bully you into saying anything.pilgrim-with-guns

The shoplifting laws and theft penalties in New Hampshire are tough. If you are brought into loss prevention or a store security office remember you are not obligated to sign anything and do not let anyone pressure you into feeling you are. More than likely the main objective is to get you to make any type of admission they can.

DO NOT let store security take your picture, they are not the paparazzi and are definitely not the police. They cannot make you do anything. You do not even need to give store security, mall security, or loss protection your identification!!!

If you are suspected of shoplifting, either store/mall security or the loss preventions department will call the police. When the cops arrive make sure you are respectful and do not resist arrest OR admit to anything either! Be polite, do not make any statements, and make sure you have some bail money with you.

3 Tips for a Smashing Pumpkin Fest’ by NH Criminal Defense Attorney Mark Stevens 603-893-0074 (24/7)

pfest-2016_laconia-logoSince its’ inception in 1991 Keene, NH has always hosted the annual Pumpkin Festival known as “Let it Shine”.  However, after the circus of events deemed “The Keene Riot of 2014” which gained national media attention, the Keene City Council rejected its return for 2015 despite it being one of Cheshire Counties most anticipated annual events. #SorryKeene

That’s when Belknap County took one for the NH team and Laconia stepped up to the plate and became the new hosts for the Let it Shine!  Pumpkin Festival in 2015.  They have taken their pumpkin fest duties very seriously for all who look forward to seeing the glowing jack o’ lanterns each year.

3 Tips for a Smashing Time at Pumpkin Fest:

  1. 1. DO… attend Laconia Pumpkin Festival 2016 on October 22 and participate in contests and events. Live Free & Carve!
  2. 2. DON’T… smash and dash. Try out some Pumpkin Bowling or see what the Pumpkin Dump Derby is all about.  After the events of the Keene Pumpkin Fest in 2014, your much less likely to be charged with disorderly conduct when Pumpking Bowling or the Pumpkin Dump Derby, a post-p’fest event.
  3. 3. DO… attempt to and break the record for the Guinness Book of
World Records. The annual event hosts contests and makes an attempt to break the Guinness Book of World Records every year for the most amount of lit jack o’ lanterns at one time.

HAPPY 4TH OF JULY from NH DWI Attorney Mark Stevens 603.893.0074 (24/7)

Wishing everyone a safe and exciting July 4th weekend from Salem, NH DUI & Criminal Defense Attorney Mark Stevens!  As always, please celebrate responsibly and remember, you don’t have to talk to the cops!

Here’s a few tips:
Before hitting the highway, make sure to check your plate and brake lights, locate and create easy access to your license and registration keep your inspection stickers up to date (and license plates). Equipment violations are a great way to find yourself in the flashing blues of a police car despite your “good driver discount-status”! Avoid giving the police a chance to legally stop you by making sure that your lights are functioning and any equipment issues have been addressed before heading out.

Have a Safe and Happy Fourth of July,
