According to DUI  attorneys roadside sobriety tests currently remain one of the most common ways used by police to measure your level of intoxication. If you find yourself in this unfortunate position, you should bear in mind that you don’t have to take these tests and here’s why…


Field sobriety tests are designed to do 2 main things:

1.) To trick you.
2.) For you to fail.


Field Sobriety Tests  (FST’s) are known to be an inaccurate measurement of sobriety. Results can be attributed to a variety of factors including weather, medication, the surface upon which they are conducted, type of footwear you are wearing, injuries, and even just anxiety.


Here are some reasons that many people refuse a field sobriety test:

1) Results can vary dramatically.

2) Tests can be inaccurate – According to the National Highway Traffic Safety Administration; several of the most popular FSTs are highly inaccurate. Take the walk-and-turn test for example. Even when administered perfectly, it only has a 68% accuracy rate.

3) Personal medical conditions can play a large role in the outcome – If you’re an individual who experiences inner ear problems; pain in your arms, feet, legs, or back; vision problems; etc., these can all play a role in the outcome of your tests, and will likely effect it negatively.


Field sobriety tests also assume that each person is exactly the same – same height, same weight, and without disabilities or other sicknesses. This means that if the field sobriety test alone can convict people, nearly one in three people would be wrongly arrested.


These reasons are just a few of the many why you should consider declining a cop’s request to perform a field sobriety test.

  2. 2. DON’T… smash and dash. Try out some Pumpkin Bowling or see what the Pumpkin Dump Derby is all about.  After the events of the Keene Pumpkin Fest in 2014, your much less likely to be charged with disorderly conduct when Pumpking Bowling or the Pumpkin Dump Derby, a post-p’fest event.
  3. 3. DO… attempt to and break the record for the Guinness Book of
     World Records. The annual event hosts contests and makes an attempt to break the Guinness Book of World Records every year for the most amount of lit jack o’ lanterns at one time.
