HAPPY 4TH OF JULY from NH DWI Attorney Mark Stevens 603.893.0074 (24/7)

Wishing everyone a safe and exciting July 4th weekend from Salem, NH DUI & Criminal Defense Attorney Mark Stevens!  As always, please celebrate responsibly and remember, you don’t have to talk to the cops!

Here’s a few tips:
Before hitting the highway, make sure to check your plate and brake lights, locate and create easy access to your license and registration keep your inspection stickers up to date (and license plates). Equipment violations are a great way to find yourself in the flashing blues of a police car despite your “good driver discount-status”! Avoid giving the police a chance to legally stop you by making sure that your lights are functioning and any equipment issues have been addressed before heading out.

Have a Safe and Happy Fourth of July,

Mark Stevens, Criminal Defense Attorney, Law Office of Mark Stevens

Merry Christmas from Salem, NH DWI Lawyer Mark Stevens 603.893.0074

The holiday season is here, and that brings with it increased police patrols all over the New Hampshire. Your chances of being stopped by the police are greater than ever due to increasing numbers of DWI roadblocks and “DWI saturation patrols”, which involve putting extra patrol cars on the road and making traffic stops for the most minor traffic infractions or equipment violations.

In fact, the New Hampshire State Police were actually given a grant to use by the end of the year that will allow them to super saturate the roadways over the holidays. Be advised you could find yourself in a variety of situations and it is best to know what to do before anything should occur!

More and more stops are made for having a plate light out, or an expired registration sticker. This is not because the police have taken a sudden interest in the robustness of your plate light; they need an excuse to stop you and look for drug or alcohol impairment. By taking a few simple precautionary steps you can reduce the risk of an unwanted encounter with the police this holiday season.

Here’s a Christmas Classic from nhdwilawyer:

Your chances of having an unwanted encounter with the police this month are high enough already. If you drive through a roadblock or even drive by a cruiser with an expired inspection sticker or a light out, it is like having a banner on your vehicle that says, “Stop Me”. A little precaution can avoid a lot of trouble.

•Make sure that you are vigilant about keeping your license, registration and inspection stickers up to date. You should check all these today. You should also make sure that all the lighting is working on your vehicles before you drive, especially at night.
•Burned out plate lights and tail lights are a magnet for blue lights during the holiday season. It is best to turn your car on and have a friend observe your plate lights and brake lights to insure they are working.

PREPARATION FOR GETTING STOPPED BY THE POLICE

It is not a bad idea to prepare for your car getting stopped. Don’t put your license in a difficult spot to pull it out quickly when you need to. Want to be super prepared? Practice taking your license out of your wallet in the safety of your home, then consider getting a registration holder if you do not already have one. (If you want one- send me an email with your mailing address and I will send you a registration holder for every one of your vehicles free of charge!) Then practice producing your license and registration fairly often, until it becomes natural. It will make it easier to do if you ever have to produce them under a pressurized roadside situation.
The best way to avoid getting arrested for DWI or any other crime is not to commit it. But many people who get accused of crimes did not commit them. If you practice the above tips you can take some proactive steps to lower your chances of being stopped and hassled by the police.

Have a Merry Christmas and Happy New Year!

New Hampshire Law of the Day: Resisting Arrest by Salem, NH DWI Lawyer Mark Stevens 603.893.0074

If you have been arrested for resisting arrest in New Hampshire or were charged with resisting detention or resisting arrest in New Hampshire, the penalties can be severe and the consequences are harsh if you are convicted.  Sometimes this charge is compiled into a DWI charge if: the driver questions the cop about why he or she is being arrested, when they are actually NOT driving while intoxicated. An arrest or conviction for resisting arrest can haunt you for a long time. If you have been charged with resisting arrest or DWI or both in any New Hampshire Court, please feel free to call me today (24/7) at 603-893-0074 for a free consultation to discuss your case and your options. I look forward to hearing from you!

Here is what they have to prove beyond a reasonable doubt to obtain a conviction for resisting arrest or resisting detention in New Hampshire:

TITLE LXII New Hampshire Criminal Code
CHAPTER 642 Obstructing Governmental Operations

RSA 642:2 (2011)

RSA 642:2 Resisting Arrest or Detention.

A person is guilty of a misdemeanor when the person knowingly or purposely physically interferes with a person recognized to be a law enforcement official, including a probation or parole officer, seeking to effect an arrest or detention of the person or another regardless of whether there is a legal basis for the arrest. A person is guilty of a class B felony if the act of resisting arrest or detention causes serious bodily injury, as defined in RSA 625:11, VI, to another person. Verbal protestations alone shall not constitute resisting arrest or detention.
